Summary

Effective May 29, 2023, AHCCCS reclassified three behavioral health provider types as high-risk under Section 6401 of the ACA and 42 CFR 455, Subpart E: Behavioral Health Residential Facility (B8), Integrated Clinics (IC), and Behavioral Health Outpatient Clinics (77). New applicants and existing providers at revalidation must pay an application fee, complete a fingerprint-based criminal background check, and undergo a site visit in addition to all other required screenings. The reclassification was announced in direct response to the May 2023 AHCCCS payment suspension action against more than 100 behavioral health providers.

What this may mean

Behavioral health residential facilities, integrated clinics, and behavioral health outpatient clinics enrolling in or revalidating with AHCCCS on or after May 29, 2023 face materially higher administrative and financial burdens, including application fees, criminal background checks, and on-site inspections. Existing providers in these categories will encounter the new requirements at their next revalidation cycle. The reclassification aligns Arizona Medicaid with the enhanced screening authority under ACA Section 6401 and 42 CFR 455 Subpart E, which also applies to federal Medicaid enrollment standards.
