Summary

California AB 2499 was signed into law on September 30, 2026, as Chapter 945, Statutes of 2026, amending the Knox-Keene Health Care Service Plan Act of 1975. Effective May 26, 2028, the law requires health care service plans and health insurers licensed in California to accept electronic medical records and supporting documentation through a standard electronic submission method. Plans and insurers are prohibited from denying, pending, or delaying a claim solely because their systems cannot accept documentation that otherwise meets their own requirements. Willful violation by a health care service plan constitutes a crime under existing Knox-Keene enforcement provisions.

What this may mean

California health plans and health insurers must build or upgrade electronic intake systems to accept standard electronic claims documentation by May 26, 2028, or face liability for claim denials attributed to their own system limitations. A willful violation of the new provisions by a health care service plan triggers criminal exposure under Knox-Keene. Providers billing California-regulated plans gain a new basis to contest claim denials that stem from a plan's inability to receive properly formatted electronic documentation.
