Summary

California SB 1049, chaptered as Chapter 1001, Statutes of 2026, amends the Knox-Keene Health Care Service Plan Act to mandate that California health plans and health insurers allow claimants at least 90 calendar days to submit corrected claims following a denial or overpayment notice based on a remediable defect. Plans and insurers are prohibited from invoking other applicable claim-filing deadlines to reject corrected submissions. Corrected-claim disputes must be eligible for the plan's or insurer's fast, fair, and cost-effective dispute resolution mechanism.

What this may mean

California health care service plans and health insurers are now required to honor corrected claim submissions for at least 90 days after a denial or overpayment notice, with no timely-filing defense available to block those submissions. Willful violation by a health care service plan constitutes a crime under Knox-Keene. Providers and facilities submitting corrected claims to California-regulated payors gain a statutory right to dispute resolution if the corrected claim is contested.
