CA SB 1323: new version, 09/27/26 - Chaptered

Score 63PRIMARYregulatoryState legislature

Summary

California SB 1323 was signed into law on September 27, 2026, and chaptered as Chapter 698, Statutes of 2026. The law strengthens existing requirements on health care provider entities regarding immigration enforcement access: it converts the existing encouragement to post a notice-to-authorities notice at facility entrances into a mandatory requirement at main public entrances, and removes the prior qualification that access-monitoring procedures be implemented only to the extent possible. The law also requires health care provider entities to train staff and volunteers on how to respond when a person in immigration custody requests notification of a family member or designated support person. These changes sunset on January 1, 2030.

What this may mean

California health care provider entities, including hospitals and other facilities, must now mandatorily post notice-to-authorities signage at all main public entrances and must establish (not merely attempt to establish) visitor monitoring and documentation procedures related to immigration enforcement access. Staff and volunteer training obligations expand to cover notification requests from persons in immigration custody. The requirements are operative until January 1, 2030.
