Score 65PRIMARYregulatoryState legislature

Summary

California AB 2499, now enrolled, amends the Knox-Keene Health Care Service Plan Act and parallel insurance law to require health care service plans and health insurers to accept electronic medical records and supporting documentation through standard electronic submission methods, effective May 26, 2028. Plans and insurers are prohibited from denying, pending, or delaying a claim solely because their systems cannot accept documentation that otherwise meets their own requirements. Willful violation by a health care service plan constitutes a crime under existing Knox-Keene enforcement provisions. The law was chaptered as Chapter 945, Statutes of 2026, on September 30, 2026.

What this may mean

Beginning May 26, 2028, California-licensed health care service plans and health insurers must have electronic infrastructure capable of accepting standard-format supporting documentation for claims, and face criminal exposure under Knox-Keene for willful non-compliance. Plans that currently reject or delay claims on the basis of system incapacity to receive electronic attachments will need to remediate those systems before the effective date. The bill defers to any subsequently adopted state or federal standard on file size, number, or capacity requirements for electronic submissions.
