2026-225 IP Rule He-W 880.01

Score 66PRIMARYregulatoryState registerNH

Summary

New Hampshire DHHS has filed an initial proposal to readopt with amendment He-W 880.01, governing the initiation of Medicaid eligibility, to implement Section 71112 of Public Law 119-21 (the One Big Beautiful Bill Act). The rule reduces retroactive Medicaid coverage periods: adults in the ACA expansion group under 42 CFR 435.119 are limited to one retroactive month, while all other Medicaid categories are reduced from three to two retroactive months. The change applies to applications scheduled on or after January 1, 2027. A public hearing is set for November 13, 2026, with written comments due November 20, 2026.

What this may mean

Medicaid beneficiaries in New Hampshire who previously could receive up to three months of retroactive coverage will receive fewer retroactive months beginning January 1, 2027, with expansion-group adults limited to one month. Hospitals, FQHCs, and other providers that rely on retroactive Medicaid to cover services rendered before a beneficiary's formal enrollment date face a reduction in the retroactive billing window. Providers serving expansion-population patients in New Hampshire are most directly affected.
