What the document says

California AB 1930, chaptered as Chapter 468, Statutes of 2026, and signed by the Governor on September 26, 2026, imposes mandatory pre-production notice obligations on persons and entities located, headquartered, incorporated, or otherwise conducting business in California that receive, are served with, or are subject to a subpoena, discovery request, or other request for information related to a civil, criminal, regulatory, or legislative investigation concerning abortion or gender-affirming health care services that qualify as legally protected health care activities under California law. The core requirement is that the responding person or entity must notify the California Attorney General at least 7 business days before producing responsive records. If federal law or a federal obligation requires a shorter response time, notice must be provided no later than contemporaneously with production, and the responding party must make best efforts to deliver records on the required response date. An exemption from the notice and pre-production hold requirements applies when the subpoena or request is accompanied by an attestation verifying that the requested information relates to an investigation or proceeding concerning activity unlawful under California civil or criminal law, and that attestation identifies the specific California law at issue. Entities subject to the exemption may rely on the representations in the attestation. The Attorney General is authorized to notify the individual who provided, sought, received, or facilitated the abortion or gender-affirming health care service at issue, to intervene in civil actions brought to resist compliance, and to commence civil actions against any person or entity that submits a false attestation. A false attestation carries a civil penalty of $15,000. Any Attorney General action must be commenced within 6 years of receipt of the relevant notice, and courts are required to award costs and attorney fees to the Attorney General in any action in which a penalty is imposed.

What this may mean

Applies to all persons and entities doing business in California that receive legal process seeking records related to abortion or gender-affirming health care services, including health care providers, health plans, health insurers, and contractors holding patient information. Puts a mandatory 7-business-day pre-production hold and Attorney General notification at issue for any out-of-state or federal legal process not accompanied by a compliant California-law attestation. A $15,000 civil penalty attaches to any false attestation, with a 6-year limitations period and mandatory fee-shifting to the Attorney General.
