MO SB 1695: Modifies provisions relating to the admissibility of evidence resulting from peer review committees for health care professionals
Summary
Missouri SB 1695, referred to the Senate Emerging Issues and Professional Registration Committee, would modify the scope of peer review committee privilege under Missouri law. The bill narrows the categories of privileged materials to memoranda, findings, deliberations, and reports while removing the current prohibition on disclosure of information acquired by persons in attendance at peer review proceedings. It also clarifies that information otherwise discoverable from original sources retains no immunity solely because it was presented, discovered, or considered during peer review, and that witnesses may not be questioned about opinions formed solely as a result of committee hearings.
