Summary

Oregon HB 4040 was signed into law on April 7, 2026, and took effect the same day as Chapter 109 of the 2026 Oregon Laws. The enacted omnibus health care bill covers a broad range of subjects: it prohibits coordinated care organizations from requiring prior authorization for complex rehabilitation technology repairs costing $1,500 or less; requires health and casualty insurers to cover medically necessary anesthesia services regardless of duration; prohibits the Oregon Health Authority from imposing Medicare Conditions of Participation on certain home health agencies; allows prerelease Medicaid enrollment for incarcerated individuals; and allows licensed occupational therapists and physical therapists to provide psilocybin facilitation services. It also modifies dental insurer claims payment rules and pharmacy services administrative organization registration requirements.

What this may mean

Oregon-licensed home health agencies gain relief from a class of Medicare CoP mandates imposed by the Oregon Health Authority. Insurers writing casualty or health policies in Oregon must now cover medically necessary anesthesia for any covered procedure regardless of duration, effective April 7, 2026. CCOs are barred from requiring prior authorization for complex rehabilitation technology repairs at or below $1,500, which eliminates a prior-authorization revenue-cycle step for DME-adjacent providers in Oregon Medicaid.
