Permanent Administrative Order PH-24-2025
What the document says
Oregon Health Authority (OHA) Public Health Division filed Permanent Administrative Order PH-24-2025 on December 18, 2025, effective December 23, 2025, amending and repealing several rules in OAR chapter 333 governing hospital and Special Inpatient Care Facility (SICF) licensing, fees, investigations, surveys, and staffing requirements. The changes implement 2025 Oregon Laws, chapter 623 (SB 842) and chapter 506 (HB 3294). On licensing fees, OAR 333-071-0210 and 333-500-0030 are amended to align SICF and hospital annual license fees with the schedule in ORS 441.020 and to add a $1,250 late fee for any hospital or SICF that fails to submit its license renewal application and fee before December 1 of each year. OAR 333-500-0030 further provides that where a hospital license covers a satellite or mobile satellite, the applicable fee equals the sum of fees that would apply if each location were separately licensed. OAR 333-071-0225 and 333-500-0031 are repealed in their entirety. ORS 441.021, which authorized OHA to charge additional fees for complaint investigations (up to $850 per investigation), full compliance surveys (up to $7,520), on-site follow-up surveys (up to $225), and off-site follow-up surveys (up to $85), has been repealed by SB 842. The aggregate annual caps of $91,000 for complaint investigations, $15,000 for full compliance surveys, and $6,700 for follow-up surveys are eliminated along with the apportionment mechanism. OAR 333-501-0010 is amended to extend the existing confidentiality protection to information obtained during the intake and triage of a complaint, not only information gathered during the investigation itself. The amended rule provides that upon conclusion of an investigation OHA may publicly release findings but must not include information that could identify the complainant or any patient. OAR 333-503-0040, which addressed hospital staffing law enforcement and violations, is repealed pursuant to 2025 Oregon Laws, chapter 506 (HB 3294). Definition rules OAR 333-071-0205 and 333-500-0010 are amended to remove the defined term "full compliance survey," renumber remaining definitions, and make minor clarifications including gender-inclusive language.
What this may mean
Applies to all Oregon-licensed hospitals and SICFs: the $1,250 late renewal fee takes effect December 23, 2025, with the December 1 annual deadline as the trigger. Elimination of ORS 441.021 removes OHA authority to charge investigation and compliance-survey fees, reducing a previously available cost-recovery mechanism. The confidentiality expansion in OAR 333-501-0010 puts at issue OHA intake and triage records as protected from public disclosure under ORS 192.311 to 192.431.
