Waiver of CY 2026 REALD and SOGI data collection requirements

Score 75PRIMARYregulatoryState MedicaidOR

Summary

The Oregon Health Authority (OHA) issued a memo dated August 28, 2026, waiving the Race, Ethnicity, Language, and Disability (REALD) and Sexual Orientation and Gender Identity (SOGI) data collection requirements in CY 2026 Coordinated Care Organization (CCO) contracts and deferring enforcement of Oregon Administrative Rule Chapter 950, Division 30. OHA cited community concerns about potential federal misuse of the data and an ongoing operational review as the basis for the pause. OHA's final data sharing with CCOs prior to the pause occurred on August 15, 2026, and will resume once the review is complete.

What this may mean

Oregon CCOs are directed to immediately halt collection and submission of REALD and SOGI demographic data and to communicate the pause to downstream contract parties with related data obligations. Enforcement of the underlying state administrative rule standards is also deferred for the duration of the pause. The suspension has no defined end date and is contingent on OHA completing its operational review.
