CO HB 1214: Sunset Substance Abuse Treatment Program Licensing
What the document says
Colorado HB 1214 implements the Department of Regulatory Agencies' sunset review recommendations for the Colorado Licensing of Controlled Substances Act, which is set to repeal on September 1, 2026. The bill proposes to continue the Act until September 1, 2041.
The bill modernizes the definition of 'substance use disorder' to more accurately reflect the conditions treated by behavioral-health-administration-licensed facilities and the practitioners authorized to diagnose those conditions. It also adopts a new definition of 'withdrawal management' intended to encompass the full spectrum of treatment concepts.
The bill replaces the existing definitions of and references to 'detoxification treatment,' 'maintenance treatment,' and 'withdrawal treatment' throughout the Act with the single term 'withdrawal management.' Additionally, the terms 'substance use disorder treatment program' and 'substance use disorder' are replaced with 'opioid treatment program' and 'opioid use disorder,' respectively, as those terms apply to identity verification for individuals participating in withdrawal management.
The bill also removes defined terms that are no longer referenced in the Act. As of the latest recorded action, the House considered Senate amendments and the matter was laid over daily.
What this may mean
Behavioral-health-administration-licensed facilities and opioid treatment programs operating in Colorado may need to review their licensing documentation, intake procedures, and identity verification protocols to conform to the updated statutory definitions of 'withdrawal management' and 'opioid use disorder' if the bill is enacted. Practitioners authorized to diagnose substance use conditions under the Act could require updated credentialing or scope-of-practice documentation aligned with the modernized definitions.
