Summary

Oregon HB 4142 in its enrolled form was signed by the Governor on April 7, 2026, and takes effect June 5, 2026, as Chapter 118 of the 2026 Oregon Laws. The enrolled text requires organizations and residential facilities designated as medical marijuana caregivers to create written policies and provide staff training, exempts hospitals and hospital-affiliated clinics from those requirements, and prohibits the Oregon State Board of Nursing from disciplining nurses for discussing medical marijuana with patients. Facilities and their employees and contractors receive protection from certain criminal liability when complying with the law.

What this may mean

Oregon residential care facilities and other caregiver-designated organizations must have written medical marijuana policies and staff training implemented by June 5, 2026. Hospitals and hospital-affiliated clinics are statutorily exempt from the caregiver policy mandate. Nursing staff statewide are shielded from Board of Nursing disciplinary action for patient counseling on medical marijuana use.
