What the document says

The Maryland Department of Health issued a notice of informal comment period running from October 30 to November 13, 2026, soliciting comments via mdh.regs@maryland.gov on proposed amendments to three chapters of the Code of Maryland Regulations: COMAR 10.09.12 (Disposable Medical Supplies and Durable Medical Equipment), COMAR 10.67.01 (Maryland Medicaid Managed Care Program), and COMAR 10.67.06 (Maryland Medicaid Managed Care Program: Benefits). The first regulatory purpose is to implement SB 276, titled "Maryland Medical Assistance Program and Health Insurance: Coverage for Orthoses and Prostheses," by enabling Medicaid coverage of orthoses, repairs, and replacements consistent with that statute. The second purpose is to expand and clarify existing Medicaid coverage of orthoses and components of orthoses beyond current regulatory scope. The third purpose is to amend prepayment authorization requirements currently in place and to establish new coverage requirements and limitations specifically applicable to replacement and repairs of orthoses and their components.

What this may mean

Applies to Maryland Medicaid managed care plans governed by COMAR 10.67.01 and 10.67.06, DME suppliers operating under COMAR 10.09.12, and providers furnishing orthoses to Maryland Medicaid beneficiaries. Puts prepayment authorization processes, coverage criteria, and repair and replacement billing practices for orthoses at issue. Informal comment deadline is November 13, 2026.
