Summary

Washington's Office of the Insurance Commissioner adopted a series of emergency rules in 2025 (R 2025-01, R 2025-07, R 2025-15), most recently effective October 27, 2025, to apply a uniform cost-sharing reduction silver load adjustment factor to Plan Year 2026 silver-level qualified health plan rates sold on the Washington Health Benefit Exchange. The emergency rules are intended to preserve consumer affordability and market stability in the state's individual health insurance market. OIC has separately initiated notice-and-comment rulemaking to provide rate development instructions beginning in Plan Year 2027.

What this may mean

Silver-level QHP issuers on the Washington individual market exchange must incorporate the uniform cost-sharing reduction factor into their Plan Year 2026 rate development under the amended WAC 284-43-6520 and new WAC sections 284-43-6800 through 6820. The emergency rule framework does not impose new provider-side compliance obligations but directly affects insurer rate filings and premium structures for exchange plans. A permanent rulemaking process for Plan Year 2027 onward is underway separately.
