Summary

Oregon Health Authority filed a temporary administrative order effective July 1, 2026 through December 27, 2026, amending OARs 410-125-0045 and 410-125-0220 to establish Caring Contacts as a Medicaid-covered hospital service with a defined billing pathway. Caring Contacts, as described in OAR 333-520-0700, are post-discharge outreach services provided to individuals leaving an emergency department following a behavioral health crisis, and are required by Oregon HB 3091 (2017). The rule adds Caring Contacts as an exception to the general prohibition on billing for hospital services provided outside licensed facilities and authorizes billing via the electronic 837I or paper CMS 1450 (UB-04) claim form.

What this may mean

Oregon hospitals that provide post-discharge Caring Contacts to patients following a behavioral health crisis can now bill Oregon Medicaid for those services on the 837I or UB-04 claim form beginning July 1, 2026. The rule resolves a reimbursement gap that OHA identified as causing hospitals to delay or forgo mandatory services under HB 3091 (2017). Hospitals and hospital employees delivering these services outside licensed facilities are now within the scope of covered hospital services under OAR 410-125-0045(5)(b).
