Summary

Oregon HB 4142 was signed into law on April 7, 2026, effective June 5, 2026, as Chapter 118 of the 2026 Oregon Laws. The law expands the definition of debilitating medical condition for Oregon's medical marijuana program, requires residential care facilities and organizations designated as medical marijuana caregivers to adopt written policies and provide staff training, and protects those entities from certain related criminal liability. Hospitals and hospital-affiliated clinics are explicitly exempted from the policy and training requirements, and the Oregon State Board of Nursing is prohibited from disciplining nurses solely for discussing medical marijuana use with patients.

What this may mean

Residential care facilities and other organizations designated as medical marijuana caregivers in Oregon must implement written policies and staff training programs by the June 5, 2026 effective date. Nursing staff at Oregon facilities gain protection from Board of Nursing discipline for patient counseling about medical marijuana. Hospitals and hospital-affiliated clinics are exempt from the caregiver policy and training mandate.
