What the document says

The Nevada State Board of Pharmacy submitted an initial draft regulation, LCB File No. R178-26I, on September 29, 2026, proposing a new section, NAC 639.818, to govern digital identity verification and the use of real-time, stop sale systems for online or non-in-person retail sales of methamphetamine precursor products as defined under NRS 639.400 and NRS 453.353. Under proposed NAC 639.818, a pharmacy is permitted to use the Internet or any other lawful means of exchange to conduct retail sales of methamphetamine precursor products, provided specific verification requirements are met. When a sale is not conducted in person, the pharmacy must submit the purchaser's identification information through a real-time, stop sale system that utilizes a secure digital identification system to establish the purchaser's identity. The proposed rule provides that the real-time, stop sale system must return to the pharmacy either an approval or a stop-sale response based on the submitted identification, and delivery of the product must not occur until that identification is approved by the system. The section cross-references NRS 639.430 as the statutory basis for Board approval of qualifying real-time, stop sale systems. The draft also reproduces and preserves existing NAC 639.815 and NAC 639.817, which set minimum technical requirements for Board-approved real-time, stop sale systems and impose duties on pharmacies to enroll in and use those systems within 90 days of Board notice, including protocols for stop-sale alerts, imminent-harm exceptions allowing sale completion with mandatory reporting within 24 hours, and temporary waiver procedures during system outages.

What this may mean

Applies to Nevada-licensed pharmacies engaged in non-in-person retail sales of methamphetamine precursor products. Puts at issue each such pharmacy's obligation to route purchaser identity through a Board-approved, secure digital identification system before completing delivery. Takes effect upon finalization of NAC 639.818 after the state rulemaking process concludes.
