Supportive Living Program (SLP) Camera/Surveillance Policy

Score 70PRIMARYregulatoryState MedicaidIL

Summary

Illinois HFS has issued a policy notice establishing detailed camera and surveillance requirements for Supportive Living Program providers delivering HCBS waiver-funded services, aligning state practice with the federal HCBS Settings Rule under 42 CFR 441.301. The policy prohibits cameras as a routine supervision or risk-management tool in resident program spaces, requires individualized ISP documentation and HCBS rights-modification procedures for any camera use that limits resident privacy, and distinguishes permissible use in non-resident operational spaces from prohibited use in dining, activity, therapy, and bedroom areas. SLP providers must attest compliance by August 31, 2027, and the annual survey tool will be updated effective October 1, 2027.

What this may mean

SLP providers delivering HCBS waiver services in Illinois must revise camera and surveillance policies, update staff training, and ensure any camera use in resident spaces is supported by individualized ISP documentation meeting the HCBS rights-modification requirements of 42 CFR 441.301(c)(2)(xiii) before the August 31, 2027, attestation deadline. Blanket camera use in dining, activity, therapy, or bedroom areas is prohibited, and audio monitoring in resident spaces is prohibited outright. The WY28 Annual Survey Tool will incorporate these requirements effective October 1, 2027, creating survey and enforcement exposure for non-compliant providers.
